Art. 1 - About the Sovranity of both Lands and about Embassies

a) The Duchy of Milan recognizes the County of Westmorland, its institutions and its dignitaries, as an independent, autonomous and sovereign county, part of the Kingdom of England.
The County of Westmorland recognizes the Ducky of Milan, its institutions and its dignitaries, as an independent, autonomous and sovereign country, part of the Sacrum Romanorum Imperium Nationis Germanicæ.

b) The embassy of Milan in Westmorland is considered sovereign territory of the Duchy of Milan.
The embassy of Westmorland in Milan is considered sovereign territory of the County of Westmorland.

Art. 2 - About the Diplomatic Immunity

a) The Diplomatic Corps of the Duchy of Milan, composed by the Duke, the Gran Chamberlain, the Chancellor and the Ambassador of Milan, has diplomatic immunity on the whole territory defined belonging to Westmorland.

b) The Duchy of Milan can declare a member of the Diplomatic Corps of Westmorland, excluded the Count and the Chancellor, "Persona non Grata".
This involves the decadence for such member from the status of diplomatic representative in the Ducky of Milan.
The Count of Westmorland can declare a member of the Diplomatic Corps of the Duchy of Milan, excluded the Duke and the Gran Chamberlain, " Persona non Grata ".

In such case the " Persona non Grata " has a week to go out of the territory giving hospitality.

c) For diplomatic immunity one intends a recognized privileged subjective juridical situation and guaranteed to some subjects in consideration of their position and institutional function. The effects of the immunities are referable to the fact that this person can’t be judged for all the crimes excluded those foreseen in the following paragraph. This immunity does not protect the said person from judgement of any crimes committed in other territories outside of the two contractors boundaries.

d) For the crimes like as brigandage, assault to the town hall or to the Castle of the capital, the diplomatic representatives of both the contractors are actionable and they will be judged according to the laws effective in that county. This does not exclude judgement for whatever crimes committed in other neighbouring counties/provinces.

Art. 3 - About the Authorization of free circulation and about Expulsion

a) The Duchy of Milan authorizes the free circulation on all of its territory of the Diplomatic Corps (where for Diplomatic Corps is intended the Chancellor and the Ambassadors) of Westmorland.
The County of Westmorland authorizes the free circulation on all of its territory of the Diplomatic Corps of the Duchy of Milan (where for Diplomatic corps is intended the Gran Chamberlain and the Ambassadors).

b) In case of closing of the Frontiers of one of the contracting parts, the Diplomatic Corps will have to give confirmation of his own presence to the Prefect and the Captain of the guest province/county who will also have to assure the safety of the foreign Diplomats.
The Diplomatic Corps before completing every action has to receive a pm of confirmation of the reading of the communication sent.

c) In case of imminent necessity, the Duke of Milan can demand the departure of the Embassy of Westmorland. The ambassador has therefore a week to leave the territory of Milan.

Art. 4 - About the Safeness of the Counterparts

a) The Duchy of Milan applies itself to protect and to help the Diplomatic Corps of Westmorland on all of its territory and in every situation.
The Count of Westmorland applies itself to protect and to help the Diplomatic Corps of the Duchy of Milan on all of its territory and in every situation.

b) The person of the diplomatic representative, recognized as such from the nomination of the Gran Chamberlain or of the Duke himself, is considered inviolable. An attack against him/her due to a non suitable protection from the guest province/County constitutes a serious offence to the counterpart.

Art. 5 - About the Annulment of this Treaty and about Translation

a) If one of signatory States wishes to annul the present Treaty, it necessarily has to make written declaration of it to the other province/County. The Treaty will be then considered ended a week after the receipt of the aforesaid communication.

b) The present Treaty is written in two versions, one in Italian and one in English. The two versions have got the same value and effect.

Art. 1 -Sulla Sovranità di entrambi i territori e sulle Ambasciate

a) Il Ducato di Milano riconosce la Contea del Westmorland, le sue istituzioni e i suoi dignitari, come una Contea indipendente, autonoma e sovrana, parte del Regno d'Inghilterra.
La Contea del Westmorland riconosce il Ducato di Milano, le sue istituzioni e i suoi dignitari, come Provincia indipendente, autonoma e sovrana, parte del Sacrum Romanorum Imperium Nationis Germanicæ.

Art. 2 - sull'immunità diplomatica

a) Il Corpo Diplomatico del Ducato di Milano, composto dal Duca, dal Gran Ciambellano, dal Cancelliere e dall'Ambasciatore di Milano, gode dell'immunità diplomatica su tutto il territorio definito come appartenente al Westmorland.
Il Corpo Diplomatico del Westmorland, composto dal Conte, dal Cancelliere e dall'Ambasciatore del Westmorland gode dell'immunità diplomatica su tutto il territorio definito come appartenente al Ducato di Milano.

b) Il Ducato di Milano può dichiarare un membro del Corpo Diplomatico del Westmorland, escluso il Conte e il Cancelliere come "persona non gradita".
Tale dichiarazione comporta la decadenza dello status di rappresentante diplomatico nel Ducato di Milano del membro in questione.
Il Conte del Westmorland può dichiarare un membro del Corpo Diplomatico del Ducato di Milano, escluso il Duca e la Gran Ciambellano come "persona non gradita".

In questi casi la "persona non gradita" avrà una settimana di tempo per uscire dal territorio ospitante.

c) Per "immunità diplomatica" si intende una situazione giuridica soggettiva riconosciuta e privilegiata, garantita per alcuni soggetti in considerazione della loro posizione e funzione istituzionale. Gli effetti dell'immunità sono riconducibili al fatto che questa persona non può essere giudicata, con l'esclusione dei reati previsti nel comma seguente. L'immunità non protegge il suo beneficiario dal giudizio di eventuali reati commessi in altri territori al di fuori dei confini dei due firmatari.

d) Per i reati di brigantaggio, assalto al municipio e al castello della Capitale, i rappresentanti diplomatici di entrambi i contraenti sono perseguibili e saranno giudicati secondo le leggi in vigore nel Territorio offeso. Ciò non esclude giudizio per qualunque crimine commesso in territori limitrofi.

Art. 3 - sulla libera circolazione e sull'espulsione

a) Il Ducato di Milano autorizza la libera circolazione su tutto il suo territorio del Corpo Diplomatico (dove per il Corpo diplomatico si intende il Cancelliere e gli Ambasciatori) del Westmorland.
La Contea del Westmorland autorizza la libera circolazione su tutto il suo territorio del Corpo Diplomatico del Ducato di Milano (dove per Corpo Diplomatico si intende il Gran Ciambellano e gli Ambasciatori).

b) In caso di chiusura delle frontiere di una delle parti contraenti, il Corpo Diplomatico dovrà dare conferma della propria presenza al Prefetto e al Capitano del territorio ospitante, che dovranno anche garantire la sicurezza dei diplomatici stranieri.
Il Corpo Diplomatico prima di completare ogni azione deve ricevere un pm di conferma della lettura della comunicazione inviata.

c) In caso di necessità impellente, il Duca di Milano può richiedere la partenza dell'Ambasciata di Westmorland. L'Ambasciatore ha quindi una settimana di tempo per lasciare il territorio di Milano.

Art. 4 - sulla sicurezza della controparte

a) Il Ducato di Milano si impegna per proteggere ed aiutare il Corpo Diplomatico del Westmorland su tutto il suo territorio e in ogni situazione.
La Contea del Westmorland si impega per proteggere ed aiutare il Corpo Diplomatico del Ducato di Milano su tutto il suo territorio e in ogni situazione.

b) La persona del rappresentante diplomatico, riconosciuto come tale dalla nomina da parte del Gran Ciambellano/Cancelliere o da parte dello stesso Duca/Conte, è considerata inviolabile. Un attacco contro di lui / lei, a causa di una protezione non adeguata del territorio ospitante, costituisce una grave offesa alla controparte.

Art. 5 - sull'annullamento del Trattato e sulla traduzione

a) Se uno degli Stati firmatari vuole annullare il presente Trattato, deve necessariamente fare dichiarazione scritta alla altra Provincia / Contea. Il Trattato sarà considerato decaduto una settimana dopo la ricezione della predetta comunicazione.

b) Il presente trattato è scritto in due versioni, una in italiano e una in inglese. Le due versioni hanno avuto lo stesso valore ed efficacia.
